In reference to our phone conversation, please find the relevant information regarding e-cigarettes in South Australia

The sale of the e-cigarette device is a breach of section 36 of the Tobacco Products Regulation Act 1997. This section states that a person must not sell by retail any product (other than a tobacco product) that is designed to resemble a tobacco product. This attracts a maximum penalty of $5,000.

Any product that contains nicotine is regulated by the Controlled Substance Act 1984.

In summary if a product does not resemble a tobacco product and does not contain nicotine ,the product therefore does not fall under the Tobacco Products Regulation Act and currently may be sold within South Australia, this however is subject to change at any time .
